By accessing or using CultMatch's services, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of the terms, you may not access the service.
2. Description of Service
CultMatch provides an AI-powered recruitment platform that includes:
- AI phone and video screening
- Culture fit assessments
- Online tests and assessments
- Candidate management tools
- Analytics and reporting
3. Account Registration
To use our services, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Upload malicious code or interfere with the service
- Attempt to gain unauthorized access to any systems
- Use the service to discriminate against protected classes
- Resell or redistribute the service without authorization
- Scrape or collect data from the service
5. Data and Content
Your Data
You retain ownership of all data you upload to CultMatch. You grant us a license to process this data to provide our services.
Candidate Data
You are responsible for obtaining appropriate consent from candidates before using their data on our platform. You must comply with all applicable data protection laws.
6. Subscription and Payment
- Subscriptions are billed monthly or annually in advance
- Prices are subject to change with 30 days notice
- Refunds are provided according to our refund policy
- Failure to pay may result in service suspension
7. Free Trial
We may offer free trials at our discretion. After the trial period, you will be charged unless you cancel before the trial ends.
8. Intellectual Property
CultMatch and its original content, features, and functionality are owned by CultMatch and are protected by international copyright, trademark, and other intellectual property laws.
9. AI and Automated Decisions
Our platform uses AI to assist with candidate evaluation. You acknowledge that:
- AI-generated insights are recommendations, not final decisions
- You remain responsible for all hiring decisions
- Human review is available upon request
- AI models may be updated to improve accuracy
10. Limitation of Liability
To the maximum extent permitted by law, CultMatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities.
11. Indemnification
You agree to indemnify and hold CultMatch harmless from any claims, damages, or expenses arising from your use of the service or violation of these terms.
12. Termination
Either party may terminate this agreement with 30 days written notice. We may suspend or terminate your account immediately for violations of these terms.
13. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of material changes at least 30 days before they take effect.
14. Governing Law
These terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
15. Dispute Resolution
Any disputes arising from these terms will be resolved through binding arbitration in San Francisco, California, except that either party may seek injunctive relief in court.
